Police are investigating after a Texas teen claims he accidentally shot his girlfriend in the chest with a rifle on Sunday morning.

As Click2Houston reports, Javon Martin, 17, is charged with criminally negligent homicide after fatally shooting 15-year-old Makaila Simon around 1:30 a.m. Sunday.

Investigators say Martin was playing with a rifle and pointing it at the victim, before pulling the trigger.

Harris County Sheriff Ed Gonzalez said:

They were inside a bedroom. There were other people home at the time, and our condolences go out to the family.”

According to ABC13, Nicole Malbrough, Simon’s mother, received a call regarding the shooting around 5 a.m. on Sunday.

However, Marlborough does not believe the shooting was an accident, Click2Houston reports.

Marlborough said:

I’m pretty sure it was not an accident.”

According to KPRC-TV, Simon had just celebrated her 15th birthday on Saturday and the couple had been fighting over cheating allegations.

As Dallas News reports, a video recorded by the victim moments before her death shows Martin pointing the rifle at her.

In the video, Simon can be heard laughing and saying:

Stop. I’m going to tell your mama.”

According to Gonzalez, investigators are still working to determine if this tragedy was truly an accident.

He said:

We don’t know if it was accidental in terms of just playing [with] the weapon and the gun went off or if there was other intent.”

Marlborough is hoping justice is served, as she grieves the “very hard” loss of her daughter.

As ABC13 reports, Marlborough said:

She’s a very sweet, giving, kind hearted person, very mindful and respectful. Everything you would want in a daughter.”

On the other hand, in addition to his latest charge, Martin has a pending case against him for unauthorized use of a motor vehicle.

His bond regarding this case has been set to $10,000.

    I believe if someone points any type of weapon at someone they should be held totally accountable for their actions. They know someone can be killed or seriously hurt. We carry weapons to protect our self’s and family. Ignorant people who do otherwise deserve to get full punishment no matter if it’s an accident or not. Of course they’re gonna say accident upon killing someone to keep out of jail. Fuck that you play you pay. Sorry ,, wtf is that to the other family ? Really !! Lock up these MF . Or let the family have an eye for an eye. PERIOD END OF DISCUSSION.

      Although I agree that this was a senseless, stupid act, I am hard pressed to think of a single instance where an unloaded gun has killed anybody.

    NO ACCIDENT !!! He needs to be held accountable for “HIS” actions. My heart goes out to the family,most of all the PARENTS. …NO ONE KNOWS What IT FEELS Like To LOSE A CHILD UNTIL YOU HAVE EXPERIENCED IT.

    To aim at a person is no accident. He may not have intended to shoot but he is still responsible for her death. It is a homicide.

      Exactly. She was 14 and just turned 15, dating and spending the night at her 17 year old boyfriends house. Wtf?

    My condolences…. but on another note, these parents need to wake up. A 14/15 year old has absolutely NO REASON at her boyfriend house let alone spending the night. He knew better than playing with a Gun anyway. Justice my be served.

    In the first place y was a 15 year old in a bedroom with a Young man her place should have been home. People just let they kids do as they want to and that time of the night. And second y was a gun in his room. Both mom shall be held responsible for that for letting her in that boy room stop being ur kids friends
